The acceptable inference of fundamentals of principles from the jurisprudential books by the jurisprudents is a valuable and effective method, particularly by authoritative jurisprudents who have not written an independent book on the principles of jurisprudence or their works have not been handed down to us. One of these jurisprudents is Najafi who has amply utilized fundamentals of principles in his book. Imam Khomeini considered this book an example of commitment to the method of qualified predecessors and one of the most effective books for himself. The present research is an attempt to find out the fundamentals of principles about the reason of intellect – with emphasis on the issue of good and bad and the criteria for inference of the commandments - approved by the author of Jawahir and compare them with Imam Khomeini’s viewpoints. Among the outstanding issues accepted and approved by the two jurisprudents, one may mention “the possibility of using the reason of intellect for inferring canonical commandment”, “the possibility of interpreting the verbal reasons with the help of intellect”, “Lack of definite necessity of the conformity of the verdict of the intellect about good and bad with the religious decree about lawfulness and unlawfulness”, and “the necessity of rigid commitment to the standards of discovering the criteria”.
