A REVISÃO DA LEI 12.711/2012: ações afirmativas em disputa no Congresso Nacional

In this article, it is presented a critical mapping of the legislative proposals in progress in the Chamber of Deputies and in the Federal Senate related to affirmative actions in education, with emphasis on color or race. It is identified that most of the proposals negatively impact the sub-quotes for black and indigenous people, either through the suppression of the ethnic-racial sub-quota, or through the combined use of criteria for other social groups, notably income. It is remarkable that no proposal in the pipeline advocates affirmative action exclusively for subordinate racial groups. With regard to the revision of the Law n. 12,711/2012, scheduled for 2022, it is identified that the proposals presented so far do not aim to advance the current affirmative action policy, recommending its indefinite expiration date, at best.
