Law n °94-654 of 29 July 1994 is about the donation and use of elements and products of the human body, medically assisted reproduction, and prenatal diagnosis. This law limits access to medically assisted procreation to only couples whose sexual union can pass for procreative, heterosexual couples. Single women and lesbian couples have to go abroad to access to artificial insemination or in vitro fertilization with sperm donation. Back in France, the women married couples can proceed with a second-parent adoption to establish their co-maternity. This paper reviews the issues in the debate around the female couples access to medically assisted procreation and filiation matters arising.
