Insignificant share in the common ownership as a basis for termination of the right of ownership

Abstract

The article deals with the peculiarities of the insignificant share in the common property as the basis for the termination of the right of ownership. The authors analyze various approaches to the definition of the concept of insignificant share in the common property right, systematized materials of judicial practice and position of Higher courts on the criteria of insignificant and significant interest of the owner. On the basis of the conducted research and analysis of judicial practice the conclusions are formulated and the ways of decision are revealed.
