Glosa do wyroku Wojewódzkiego Sądu Administracyjnego w Rzeszowie z dnia 7 kwietnia 2020 r. (sygn. akt II SA/Rz 122/20)

Abstract

​The commented judgment defines the right to take the initiative to commence expropriation proceedings. The court denies the owner of the property this right, holding that legal entities other than the municipality, county and province can only “initiate” the executive body of the relevant local government to file an application to launch expropriation proceedings. It was pointed out that the right of the executive body of a local government unit to file a motion to initiate expropriation proceedings is its autonomous right. The gloss critically referred to this stance.
