Algorithmic Administrative Decision

Abstract

This study aims to examine the impact of the application of artificial intelligence on administrative decision theory. Algorithmic software has become increasingly employed at the public administration in choosing between multiple alternatives, allowing the emergence of a new type of decision called "algorithmic administrative decision". We concluded that this new type of decision imposes on the judiciary and legislation a rapid adaptation with the use of algorithmic processing systems for data on the traditional theory of administrative decisions through a conscious update of its legal framework to ensure effective judicial control of their legitimacy on the one hand, and real protection of citizens ’rights on the other hand.
