Constitutional Protection of the Environment under the Amendment of the Algerian Constitution for the year 2016

Abstract

In this paper, we will discuss the importance of constitutionality as one of the mechanisms created by the constitutional legislator to achieve environmental protection. And, it becomes more important when it comes to presenting the views of the jurists and their attitudes towards the question of the importance of constitutionality. Thus, the issue of the environment has become a global affair. This has also been reflected in the domestic legislation of countries, especially through their constitution, which is reflected in the adoption by the Algerian legislator of the right to a sound environment in the constitutional amendment of 2016.Therefore, the appropriate question is what is the appropriateness of the legal system of the constitutionality mechanism with the right requirements in a recognized environment at the level of law? And, how effective is constitutional protection in legislating legislative texts related to environmental protection?
