Aequitas romana: principio informatore del diritto
Abstract
A brief examination of Roman Aequitas as a regulating legal principle where the law fails or is incongruous, ensuring the right degree of elasticity, not only in case-based systems (Common Law) but also in codified ones (Civil Law) which sometimes, due to the rigidity of the regulations, risk not realizing the most correct or most suitable solutions for the times.
