LA NULIDAD PROCESAL COMO TÉCNICA PROTECTORA DE LOS DERECHOS Y GARANTÍAS DE LAS PARTES EN EL DERECHO PROCESAL CHILENO The procedural nullity as a protective technique of rights and guarantees of the parties in the Chilean procedural law

Abstract

Este trabajo tiene por objeto analizar la nulidad procesal en el procedimiento civil chileno y determinar los inconvenientes que existen al construir un sistema anulatorio teniendo como base principal la estructura orgánica de los actos procesales. Se propone un nuevo enfoque de la nulidad procesal como técnica o instrumento procesal que tiene por objeto el resguardo del ordenamiento jurídico a través de la protección de las garantías procesales de los litigantes.This paper aims to examine the nullity of procedures in the Chilean civil procedure and determine the problems that exist in building a nullity legal system having as a base the main organizational structure of the procedural acts. It is proposed a new approach of the procedural nullity as a technique or instrument whose aim is to safeguard the legal system through the protection of the procedural guarantees of the litigants.
