This research aims to study the verification of parameters used by the 1CC of the TJCE when judging habeas corpus related with the crime of robbery related to the excess of term of the prisional precautionary measures from January to June of the year 2013. Therefore, the methodology used is the investigation of the documentary-bibliographical, with pure research qualitative and descriptive approach to the objectives. It is found that there is a judgment parameter with similar lines of reasoning, but there is no specific time reference and determined to be considered an illegal prison.
