Judical control of subordinate legislation in England
Abstract
This academic work deals with issues concerning judicial control of subordinate legislation in England. Thereafter introductory remarks, in the second part of this paper the organization of courts, their jurisdiction and the manner of initiating the procedure for assessing the legality of subordinate legislation was analyzed. The third part of the paper is devoted to the criteria for assessing the legality of subordinate legislation and the types of their irregularities. In the fourth part, the effectiveness of the judicial control of the subordinate legislation was examined, and finally, in the fifth part, its limitations were considered. The author concludes that the system of judicial control of the subordinate legislation, regardless of certain limitations, is effective and provides adequate legal protection of human rights and freedoms.
