SOME ISSUES OF THE SCIENTIFIC WORLDVIEW AND THE NEW CHALLENGES FOR THE LAW

Abstract

The article examines the most important trends in the development of the modern scientific worldview in connection with the law. The article attempts to establish some new parameters of the modern scientific worldview: the changed status of the cognizing subject, the loss of the habitual sensory-figurative perception of it, the emergence of a new symbiosis of material and ideal, not directly affected by the senses. Attention is drawn to the fact that the law still does not define the most important categories denoting this symbiosis: signal (including pre-air signal), network signal, code. The purpose of the work is to establish a correlation between new phenomena in the modern scientific worldview and law. Methods: description, interpretation, theoretical methods of formal logic, formal legal method, extrapolation method. The research materials are the works of scientists in the field of physics, quantum physics, philosophy, theory of law, as well as the results of the author’s scientific research on the physical essence of network space, mathematization, digitalization and standardization of law. It is concluded that a code, a signal, a network signal are not physical objects in the common sense. This is a new physicalideal (symbolic) phenomenon, which has not been studied by either physicists or legal scholars. The code is a recording system; it fills the record with a certain meaning and content. It is a combination of material and ideal lying on top of the electrical signal and at the same time, it is capable to change the physical properties of the signal.
