Concordato in continuità ed omologa su approvazione della classe minoritaria svantaggiata nel Codice della crisi CCII

Abstract

The crisis of the par condicio creditorum accentuated by the increase of new privileges to the detriment of unsecured creditors accompanies the application of the new value distribution rules in the CCII concordat in continuity. The composition agreement in continuity is approved if approved by all classes, but failing that even if approved by only one class of creditors who would be at least partially satisfied by respecting the legal rules of graduation.
