Abstract

Magistrate’s independence and his disciplinary liability. Comparative law elements. In the disciplinary liability matter is very important to be realized a balance between the necessity to penalize the magistrate’s behavior that is incompatible with the deontological exigencies imposed to this professional body, and the necessity to respect his independence. In the balance achievement, the problem appears especially in the incrimination situation as a disciplinary deviation of some acts linked with the way the jurisdictional activity is carried out.
