This paper argues the racism remain for a long time in the government logics and politics apply to the indigenous populations, are currently. The racism roots blends with intercultural and human rights discourses, and came from the mixed-race superiority idea. We focus the attention on the popular referendum to 16 indigenous communities located on the central valley of Oaxaca. The referendum is carry out by the CONAGUA, and it began in 2015 as of today. We show among the indigenous communities and the government policies, arises international rights that becomes in a social and natural resources dispute.
