REREADING OF THE LEGAL ADMINISTRATIVE REGIME AND THE THEORY OF THE BEST RIGHT: IMPACTS OF CONVENTIONALITY IN THE INTER-AMERICAN SYSTEM OF HUMAN RIGHTS
Abstract
The paper describes the impacts of conventionality on the legal regime of Administrative Law in the laws of the member countries of the Inter-American Human Rights System (IACHR). It explores the reflections of the international treaties on human rights, decisions, and advisory opinions of the Inter-American Court of Human Rights in the interpretation and application of common principles of Administrative Law in the Latin American region. To this end, it discusses appropriate changes, in theory, in the organization of national public administrations based on the theory of the best right formulated by the Argentine jurist Jorge Luis Salomoni. In short, it seeks to enable dialogues between the member states of the inter-American system to build better levels for the protection of human rights in the region.
