Zarys sytuacji prawnej współtwórcy utworu audiowizualnego

Abstract

The aim of this publication is to present legal regulations regarding co-authors of an audiovisual work. Due to the specificity of an audiovisual work, which contains combinations of various creative contributions, doubts arise in the context of how to determine the group of its co-authors. While the legal status of the director, the cinematographer, the creator of the adaptation of a literary work, the creator of musical and verbal and the script writer is clearly stated in Polish regulations, the legal status of other entities involved in the production of an audiovisual work has not been regulated. The issue discussed includes the premises elaborated by the doctrine and jurisprudence that are necessary to qualify an entity as a co-author of an audiovisual work and also the entitlements which arise from the co-authorship.
