Fine pena mai: l’ergastolo ostativo nel dibattito legislativo in corso

Abstract

The issue of legitimacy of life imprisonment has recently received particular attention at both the national and European levels. The regulation of the most severe instrument available to a democratic system represents an important benchmark for the effective implementation of the principle of rehabilitation and human dignity. The paper, therefore, analyzes some of the critical issues that have emerged in recent Constitutional Court’s decisions and legislative reforms.
