This paper describes a trend consistent in the loss of influence of the traditional criminal law on the design of criminal policy, being replaced by perspectives from the theory of public policy. To describe this we outline the evolution of contemporary penal control and the relationships between the theory of public policy and criminal policy. We argue that the current nature of penal control is Applied Criminal Policy (ACP) symbolized in the emergence of new disciplines that explain and “fight” criminality. Therefore we conclude: 1) That el concept of criminal policy is subjects to the dynamics and tensions of the contemporary penal control; 2) The protagonism of new disciplines and actors in the analysis of the criminal phenomena is concretized in the emergence of the paradigm of applicability; 3) This tendency is marked by a “remedial and short term approach” of public safety.
