PENYELESAIAN WANPRESTASI PERJANJIAN SEWA BELI MOTOR BERDASARKAN ASAS PACTA SUNT SERVANDA

Abstract

This paper aims to determine the completion of the default contract for the purchase of a motorcycle in progress with a motorbike guarantee. This shows that the settlement of the defaults in the motor vehicle lease agreement has not been settled based on the legislation in force. This research is a type of qualitative field research using a sociological approach to law that is looking at the problem from the perspective of the community. The results of this study state that the form of settlement of defaults in the motor vehicle lease agreement based on the principle of Pacta Sunst Servanda. at PT. BFI Finance Tbk. North Luwu Branch is through negotiation efforts or completing a family, urging the debtor to make payments and deposit collateral, but if the measure fails then withdrawal of the collateral is in the form of the motor itself.
