The proposed research focuses on some kafkaesque studies and tips, presents in Gustaw Herling’s production. The theme of guilt and the study Before the Law offer the opportunity to outline a european path, favoured by Gustaw Herling’s second life in Naples. Starting from Franz Kafka, this research intends to show a small trace of the enormous consistency, especially philosophical, of Herling. Thus, from literary criticism to philosophy or political investigation, the step is short, confirming the interdisciplinary nature of an author, who constantly lends himself to an unprecedented reading, and who is surprisingly able to actualize himself, in modernity. The study thus intends to highlight aspects of Legal philosophy present in his enormous and diversified production. From Poland to Naples describing the Europe.
