This paper examines the importance of a prior Environmental Impact Study when approving genetically modified organisms (GMOs) and their derivatives. With this in mind, this paper explores the Act n° 11.105/2005, its objectives and normative structure, as it is the primary legal instrument that authorizes the use of GMOs. Moreover, it also regulates the process for its release in the environment. Furthermore, this study analyzes the complexities of GMOs; their environmental impact; characteristics; influences; and legal dictates. Finally, this research concludes that there should be Environmental Impact Studies when analyzing transgenic products. Our chosen methodology was literature review with deductive reasoning.
