This article aims to analyze the controversy surrounding the ownership of public sanitation services after the approval of Federal Law No. 14.026/2020, known as the New Regulatory Framework for the Sector. It seeks to investigate whether the changes implemented by the new legal diploma represent a veiled transfer of state responsibility for the universalization of services to the private sector, especially with regard to sanitary sewage. Without intending to exhaust the theme, the objective was to carry out an eminently qualitative and exploratory bibliographic research supported by the inductive method. It was concluded that the diploma violates the competences of the municipalities and that, to a certain extent, it transfers responsibility for the provision of sanitation services to the private sector, attacking the State's capacity to achieve the longawaited universalization.
