ON THE IMPLEMENTATION OF THE UN MODEL STRATEGIES ON REDUCING REOFFENDING IN NATIONAL LEGISLATION (CASE STUDY OF THE RUSSIAN FEDERATION)

One of the priorities of global importance is to reduce reoffending. The article examines the issues of the development and implementation of the United Nations standards on crime prevention and criminal justice in the Russian legal system, in general, and the UN model strategies on reducing reoffending, in particular as a universal model adapted to national conditions. The purpose of the paper is to identify the fundamental features of the UN strategies and their implementation in Russian legislation at the present stage. The methodological basis of the research consists of the provisions of the dialectical method of cognition. The methods of formal legal and logical analysis, deduction and induction are also used. Results: the study reveals that the model strategies recognize individualization at each stage of criminal proceedings as the main condition for reducing reoffending. The strategies call for the effective implementation of noncustodial measures, including the replacement of criminal liability with other types of corrective measures designed to exclude offenders from the criminal justice system and provide an alternative to detention. The strategies address the functioning of rehabilitation programs aimed at reducing reoffending, which are based on the needs of specific individuals. The author concludes that the pace of development of Russian legislation and law enforcement practice complies with the most up-todate UN standards in the field of crime prevention.
