THE BRAZILIAN CIVIL PROCEDURE CODE AND STJ’S STATEMENT No. 410: THE PERSONAL INTIMATION AS A REQUIREMENT FOR THE APPLICATION OF ASTREINTES

Abstract

The article analyzes the importance of astreintes as an instrument for the indirect execution of obligations and the requirement of a personal intimation of the party as a condition for its application, under the terms of statement n. 410 of the Superior Tribunal de Justiça’s Summary. Subsequently, it highlights the doctrinal and jurisprudential understandings on the subject according to the new brazilian Civil Procedure’s Code of 2015.
