The procedures for protection of mobbing at the employer
Abstract
Taking into account the consequences and the delicacy of the procedure of determining the cases of mobbing, the Law on Prevention of Harassment at Work foresees few different possibilities of exercising the protection of mobbing, and they are: Through the procedure of mediation at the employer Through the procedure of determining responsibility of the employee accused of mobbing at the employer Through the proceedings before the competent court The topic of this paper is the procedure for protection of harassment at work at the employer. The above mentioned Law has been applied for four years. A great number of procedures for protection of harassment at work have been conducted at the employer and also final judgements in cases of law-suits for mobbing have been made. As expected, the earlier the phase of noticing and sanctioning the act of harassment, the lesser and easier the negative consequences are. That is why it is of great importance for the procedure for protection of mobbing at the employer to be conducted properly and efficiently.
