JUDICIAL ACTIVISM AND ITS MULTIPLE DEFINITIONS

Abstract

The theme of judicial activism has grown more and more in Brazil, not existing only a few academic works, but also not so many in volume. The study intends to demonstrate the existence of the debate that has already started on Brazilian soil, with the object of investigating which is the best concept for knowing the usefulness, or not, of the functionality of the expression. Do not forgetting the authors of the analysis in foreign literature, especially the North American one, cradle of the creation of the expression judicial activism.
