The Legal Forms of Divorce and the Status of Divorce in Rage in Islamic Shariah
Abstract
Relationship with other human is a very sensitive issue. The one who manages his relations is successful. The matrimonial bond is meant to be strengthened human bonds. The collective wisdom of Islamic teachings emphasizes that it should not be entrusted to temporary emotionality and abrupt rage. The feelings like anger, rage and fury are the part of human instinct but they should be controlled by reason. Reason cannot be allowed to be ridden by them. The Qur’anic phrase ” “ والکاظمین الغیظ praises the people who do not let rage beyond control. Otherwise, it is injurious to human relations. Rage crushes matrimonial bond when expressed through divorce. When he returns to senses, then regrets but this is just a cry over spilt milk. This paper seeks to legal status of the divorce given in regeous condition with evidences from the main sources of Islam.
