Genetiškai modifikuoto maisto ženklinimo tvarka pagal EB teisę

Abstract

Straipsnyje nagrinėjamas vienas iš pagrindinių genetiškai modifikuotų (GM) maisto produktų teikimo į rinką reglamentavimo Europos Bendrijoje (EB) sistemos elementų – į rinką patiekto genetiškai modifi­kuoto maisto ženklinimas. Visų pirma straipsnyje analizuojami pareigos ženklinti genetiškai modifikuo­tus maisto produktus tikslai ir turinys pagal EB genetiškai modifikuotų produktų teisinį režimą bei susi­jusią Bendrijos teismų praktiką. Tuo remiantis toliau gvildenama, ar esamas teisinis reglamentavimas pajėgus užtikrinti keliamus tikslus, ypač įgyvendinti vartotojų teisę rinktis. Article analyses one of the elements of Community GM food regime – namely labelling requirements for the GM food placed on the market. Firstly the aims and the content of labelling requirements are exami­ned in the context of GMO legal framework and the relevant case-law of the ECJ. Based on this analysis an evaluation is carried out whether this legal framework is suitable and effective in ensuring one of the main aims of GM food labelling – consumers’ right of choice.
