The Protection of the Fundamental Right to Informational Self-Determination in the Context of Labor Relations
Abstract
This study is part of the information society context, which key feature is the elevation of information as an economic good. The right to privacy presents itself as extremely vulnerable ahead of advances in technology. It’s needed a more dynamic and plural protection of that, characterized in protecting the fundamental right to informational self-determination. Faced with the possibility of misuse of employee’s personal data by their employers, on admission and dismissal, it’s justified the need for actualize the right to informational self-determination in the context of labor relations, with the desideratum to prevent sensitive data from being used by employers.
