Disabilità e inclusione: diritti e strumenti di tutela

Abstract

Normative provisions and case-law on the issue of disability are paradigmatic of a renewed approach to this topic, that appears more consistent with the founding values of our constitutional framework, in which the protection of the disabled cannot be reduced, from a ‘negative’ perspective, to a simple protection from discrimination, since it should aim, from a ‘positive’ standpoint, at ensuring that disabled are not precluded from the full inclusion in their social context and the realization of their personality.
