Koncepcja „narodów cywilizowanych” i jej anachroniczne zastosowanie w prawie międzynarodowym publicznym
Abstract
THE CONCEPT OF „CIVILIZED NATIONS” AND ITS ANACHRONOUS APPLICATION IN PUBLIC INTERNATIONAL LAW The following study discusses the issue related to the concept of „civilized nations” in the doctrine of public international law. Examples of international legal regulations in which references to „civilized nations” appeared in the 19th century and the first half of the 20th century are indicated, as well as those that contained references to this concept after World War II. The need to change these regulations is indicated in order to replace the reference to this anachronistic concept with another one; for example, the term proposed by the International Law Commission: international community.
