The principle of contradictoriality and weapons equality within the criminal process summary
Abstract
Contradictoriality is a requirement that has been imperatively established by virtue of the historical evolution of the criminal process. Starting with the existential periods of the inquisition process and up to the appearance of the contradictorial process, the state of the parties has been greatly modified within the criminal process, so that today the parties’ equality is totally recognized throughout the trial. However, being regulated at the level of principle within the criminal procedural legislation in the Republic of Moldova, the contradictoriality and weapons equality within the criminal process is not fully accomplished at the moment.
