FACTORS TO BE IDENTIFIED WHEN CONDUCTING A FORENSIC PSYCHOLOGICAL EXAMINATION IN CIVIL CASES INVOLVING ETHNIC FAMILY CONFLICTS

At the present stage, the number of interethnic marriages (both registered and unregistered) is increasing in Russia, which is due to a range of reasons, primarily the growing number of migrant workers and refugees. In conflict situations, especially when spouses get divorced, ethnic and religious factors inevitably affect children’s psychological safety. Purpose: to determine the factors to be established when conducting a commission forensic psychological examination in civil cases involving ethnic family conflicts. Methods: dialectical method of cognition, as well as general scientific (observation, description, analysis, synthesis, etc.) and specific scientific (comparative legal, statistical, sociological, etc.) research methods, including a statistical analysis of specific forensic psychological examinations of disputes over the order of upbringing and residence of children in interethnic and national families. Results: based on the situational approach, the factors that are important in determining the place of residence of children with one of the parents involved in a family conflict are highlighted: psychological, ethnic, religious. The article notes the influence of religious and ethnic factors on the psychological safety of minors in interethnic and national families and, as a consequence, on expert diagnostics of child-parent relations. Depending on the degree of influence of various factors and the attitude of minor children to participants in a family dispute, forensic situations are differentiated.
