The resistance of the rule of law with reference to the regularisation of building offences

Abstract

With this ruling, the Constitutional Court addresses the legal issue of the relationship between the rule of law and regional (indirect) legislative power in criminal matters. Specifically, the relationship between transversal state competence in criminal law matters and the shared competence of the government of the territory in which the building law is carried out is examined in depth.
