CRIMINAL LAW ASPECTS OF THE CRIME OF PURCHASE, STORAGE, TRASPORTATION, PROCESSING FOR SALE OR DISTRIBUTION OF KNOWINGLY ILLEGALLY CUT TIMBER
Abstract
The paper is devoted to the study of criminal liability for purchase, storage, transportation, processing for sale or distribution of knowingly illegally cut timber. The paper aimes to consider the criminal law characteristics of this offense and help law enforcers in classifying the crime correctly guided not only by criminal law, but also by the rules governing the turnover of timber. Research methods of analysis, synthesis and comparative law were used. The present research-set can be used in law enforcement and scientific activities in the learning process. As the result of the study, the author comes to the following conclusions: the position of Article 191.1 of the Criminal Code within Chapter 22 of the Criminal Code needs to be changed based on the definition of the object of offence; it is necessary to give a legal definition to the concept of timber, which is the object of this crime; besides socio-economic changes in our country and the practice of Article 191.1 of the Criminal Code objectively requires changes and additions to the criminal, public and forest legislation of the Russian Federation concerning the regulation of legal issues of timber trade optimization, which will more effectively combat criminal trafficking of timber.
