Flexibilities of TRIPS and access to medicines

Abstract

This paper examines, synthetically, the flexibility mechanisms of the TRIPS provisions set forth in the Doha Declaration and the decision of the General Council for TRIPS of August 30, 2003. It further identifies the main challenges that currently exist for the actual use of these mechanisms.
