The question of amnesties for infringement of building regulations in protected areas

Abstract

This work aims to address the sensitive issue of amnesties for infringement of building regulations’ admissibility conditions inside of Protected Areas. In particular, the article focuses on some interpretative problems related to the third amnesty application (art. 32 D.L. 269/2003) within Italian Parks. Due to the numerous requests for amnesty remained to be examined, the question is still relevant. The discussion ends with a reflection on sanctioning powers of Protected Area’s Managing authority related to illegal buildings standing on its territory, when a request for amnesty is currently pending about these
