ANALOGY IN THE CRIMINAL LAW: THE HISTORY AND THE PRESENT

Abstract

The article is devoted to the historical and legal analysis of analogy in criminal law of our country. In this work the attitude to analogy of the law and the legal analogy in modern period is considered. The author comes to the conclusion that the facts of analogy application in the criminal law nowadays take place that should be considered as infringement of main principles of a criminal law and the criminal policy.
