L'archeologia preventiva nella normativa recente / The preventive archaeology within the current legislation

Abstract

Lo scritto analizza l’attuale normativa sulla c.d. valutazione preventiva di impatto archeologico (ViArch) introdotta dall’art. 28, comma 4 del D.Lgs. 42/2004 e successivamente disciplinata, nei suoi aspetti procedurali, dalla L. 109/2005, confluita, oggi, nel D.Lgs. 163/2006 (codice dei contratti pubblici). In particolare, nel presente lavoro, l’attenzione è stata posta sulle diverse fasi del procedimento cercando di evidenziare anche i vantaggi conseguenti all’introduzione di tale normativa. This work examines the current legislation about Archeological Impact Assessment (AIA) regulated at the beginning by article 28 D.Lgs. 42/2004 and, later, regulated by Law n. 109/2005 and D. Lgs. 163/2006 (Code of public contracts) about AIA’s. The present report draws attention to different section of the process pointing to the benefits resulting from this new regulation.
