Tension between theory and practice comparative analysis between the Islamic financial system and the laws of the Israelites العشور بين النظرية والتطبيق دراسة تحليلية مقارنة بين النظام المالي الإسلامي وتشريع بني إسرائيل

Abstract

The system seeks to shed light on this system in the Islamic and Israel (Mosaic), to clarify the points of convergence and differences between them depending on the original texts of the Holy Quran and the Sunnah of the Prophet Muhammad for the Islamic financial system and the book of the Torah (Covenant The old) for the legislation of the children of Israel, and has taken a comparative analytical approach in this study, which committed neutrality and make comparisons to show the confusion that prevailed between the laws of Israel by their counterparts who have initiated economic laws to serve their interests. The research was divided into an introduction, two sections, a conclusion and a catalog of sources and references preceded by a list of margins. The research concluded with a conclusion that included the main findings of the research. يعد نظام استيفاء العشور نظاما اقتصاديا قديما قننته النظم والشرائع، يحاول البحث إلقاء الضوء على هذا النظام في الشريعتين الإسلامية وبني إسرائيل (الشريعة الموسوية)، لتوضيح نقاط الالتقاء والاختلاف بينهما اعتمادا على النصوص الأصيلة المتمثلة بالقرآن الكريم والسنة النبوية الشريفة بالنسبة للنظام المالي الإسلامي وكتاب التوراة (العهد القديم) بالنسبة لتشريع بني إسرائيل، وقد نهجت في هذا البحث نهجا تحليليا مقارنا التزمت فيه الحياد وإجراء المقارنات لبيان الخلط الذي ساد تشريع بني إسرائيل من قبل كهانهم الذين شرعوا قوانين اقتصادية تخدم مصالحهم . تم تقسيم البحث إلى مقدمة ومبحثين وخاتمة وفهرس للمصادر والمراجع تسبقها قائمة بالهوامش وقد ختم البحث بخاتمة تضمنت أهم النتائج التي توصل إليها البحث .
