This study frames the importance of Human Rights Constitution development in the process of democratic transition agreed in the American convention of San Jose’s pact. Our analysis highlights the protection of political rights stated by Venezuela, Nicaragua and Ecuador in their democratic process to ensure the participation of characters in the development of a new State. The condition to increase the levels of democratic institutional framework to achieve the correct application of Fundamental Rights and the risks of delegative democracies in Nicaragua, Venezuela and Ecuador, were defined in this document through an extensive analysis of definitions and typologies of democratic systems.
