PRIVATE COLLABORATION IN THE STRUCTURING OF PUBLIC WORKS: THE EVOLUTION OF JOINT SCHEMES AND THE RISK DIVISION

This article deals with the different forms of private initiative in the design and execution of public works projects. This action may occur in the internal phase or in the external phase of the bid. From the model included in Law no. 8.666/93, which is strictly related to the participation of the private sector, the collaborative schemes for project structuring, provided by the Differentiated Contracting System and by the Law of Public companies, are analyzed. From this analysis, it has been stated that the lens constructed from the General Law of Tenders no longer applies to new regimes. On the other hand, tools such as design and build models and the risk matrix must be used in specific objects, with a view to the technical and economic efficiency of the contract.
