The Criminal Preventive Policy in Combatting Drug Crimes -A comparative study-

Abstract

The preventive policy is the best way to envisage the existence of the criminal personality, and since the phenomenon of illicit drug dealing is increasing in Iraqi society; We chose it from this aspect, especially after the issuance of the Narcotic Drugs and Psychotropic Substances Law No. (50) for the year 2017 AD, by examining the legislator’s preventive policy in this law and in the legislations subject to comparison.The criminalization contained in the law is of the type of preventive (precautionary) criminalization, and the criminal behavior in the drug law is such as crimes of danger and not harm. Therefore, objective prevention (the subject of our discussion) aims to prevent harm that affects the health of individuals, the decline of human energy in society and the economy and the spread of crime and others, the law also included many forms of behavior that the legislator incriminated,
