Contraddizioni e antinomie nella regolazione dello sciopero nei servizi pubblici essenziali

Abstract

The study analyses the Italian regulation of the right to strike in essential services. It reviews the restrictive interpretations, weakening conflict and trade unions. In contrast to this model, the study proposes a concept of the right to strike enhancing conflict and collective autonomy. The strike is a collective instrument of resistance to demand fair working conditions the guarantee of fundamental constitutional rights and to promote substantive equality. It is a tool for the defence of public services
