LOS SISTEMAS INFORMÁTICOS EXPERTOS DE TOMA DE DECISIONES Y LA VOLUNTAD COMO ELEMENTO DE VALIDEZ DEL NEGOCIO JURÍDICO

Abstract

Un sistema informático experto permite que un sujeto ­después de activar el sistema- perfeccione negocios jurídicos ignorando las circunstancias particulares del negocio celebrado ante lo cual es posible preguntarse ¿si la respuesta del computador forma parte de la voluntad del usuario y si realmente existe en los términos del Código civil una clara voluntad psicológica, consciente, libre y actual? que pueda dar por cumplidas las exigencias que el Código Civil formula a la voluntad como requisito de validez del acto jurídico.An expert computational system allows the individual who has activated it to complete juridical acts ignoring their particular circumstances. This leads to the following question: Is the computer's response a part of the will of its user? Is there in this case a clear, conscious, free, and present will, in the terms demanded by the Civil Code of the will as a requisite for the validity of a legal act?
