Abstract

Background. The relevance of the issue under study lies in the fact that the fight against trafficking of narcotic drugs, psychotropic substances or their analogues is one of the main tasks of law enforcement agencies to ensure public safety. The solution to this problem is complicated by the fact that drug crime in general and the crime in question in particular is latent in nature, so it is important to consider the most pressing problems of identifying and proving crimes in criminal cases under the Article 232 of the Criminal Code of Russia, which is the main purpose of the study. Materials and methods. The methodo-logical basis of the research includes both general scientific and private scientific methods of research: comparative legal, sociological, psychological. Judicial practice for these crimes is not as diverse as for other crimes in the field of drug trafficking, however, sen-tences of the Leninsky District Court of Penza were taken as examples. Results. The result of the study is a comprehensive consideration of the problems of identifying and proving the category of crimes under consideration. Conclusions. As the main conclusion, it is worth pointing out the need for interaction between various departments of the internal af-fairs bodies in order to combat the organization or maintenance of dens for the consumption of drugs.
