Przyczynienie uzasadniające zmniejszenie odszkodowania należnego pacjentowi na gruncie art. 362 k.c.

Abstract

This article explains the institution of contributing injured, which is regulated in article 362 Polish Civil Code. It proposes a mechanism for the application of this institution. The main area of research is to differentiate the concept of “contributing” and “contributing to justify a reduction in compensation”. Describes the tendencies of this problem, which were appeared in the jurisprudence. General remarks related to the most common situations in which the patient (during treatment) contributes to the creation or increase damage. In terms of research included noncompliance to the doctor’s recommendations, giving false information  bout health condition and eventually refusal to undergo the treatment. The article also raised issues related to the process of reduction of compensation.
