THE DEVELOPMENT OF PROFESSOR L.L. KANEVSKY’S IDEAS IN CONTEMPORARY CRIMINALISTICS
Abstract
The article reveals the role of Professor Lev Lvovich Kanevsky in the study of the problems of investigation of crimes committed by minors and their prevention. Many of his proposals expressed more than 50 years ago are still relevant and are the subject of discussions on scientific forums, cause disputes when implemented in practice. Thus far, insufficient attention is still paid in practice to the study of the minor offender's personality, despite the great importance of such knowledge not only for the comprehensive investigation of crimes but also for their prevention in the future. There is no clear understanding of what and to what extent it is necessary to study about the adolescent's personality. Investigators are guided by the Code of Criminal Procedure of the Russian Federation, which sets the task, but does not specify the ways and limits of its solution in practice. The same problem arises with regard to the involvement of educators and psychologists in investigations with a minor suspect, accused, witness or victim. Which (familiar or unfamiliar) educators to invite, in which cases educators should be engaged, and in which – psychologists, as well as many other issues are among the problems that scientists suggest to solve in different ways, and in practice these issues are not even considered, since the main problem for investigators is the organization of any specialist's participation in the investigative action to comply with the norms of the Criminal Procedure Code. L.L. Kanevsky offered solutions to these and many other problems in his works. The disciples of Lev Lvovich continue to develop his ideas and study modern problems related to the investigation of crimes in w hich minors ar e participants.
