NOTION AND SUBJECTS OF WARRANTY RELATIONS IN INTERNATIONAL PRIVATE LAW

Abstract

The article analyzes the notion of international banking warranty; defines their position in the international private law; studies the features of the object and subjects of international warranty relations. Special attention is paid to the issue of who can be a guarantee in Ukraine and other countries. The author reveals collisions in Ukrainian legislation, as well as inconsistencies between legal norms, regulating banking warranties in Ukraine, and the norms of Unified rules for warranties on demand; proposals on changes in the functioning Ukrainian legislation are made.
